Terms of Service

These Terms of Service ("Terms") govern your access to and use of NerdExam ("we," "our," or "us"), a service operated by WADL Solutions Limited, a company incorporated in Hong Kong (CR# 80143234). By creating an account or purchasing exam access, you agree to these Terms.

1. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials. NerdExam uses Clerk for authentication and may offer passwordless sign-in options.

2. Exam Access & Purchases

Exam access is sold on a per-exam basis: Exam Access at $49.99 for 30 days, or Exam Pro at $69.99 for 90 days of unlimited access. PDF downloads are available as an add-on for $19.99 per exam at checkout. All prices are in USD. Access begins immediately upon successful payment.

3. Intellectual Property

Original NerdExam content (the platform, source code, design, brand, and editorial materials produced by us) is protected by copyright and remains our exclusive property. You may not reproduce, distribute, or commercially exploit our original content without prior written consent. Practice question content and community discussions are user-contributed and governed by Section 4.

4. User Content & Community Contributions

NerdExam is an interactive computer service hosting content contributed by registered community members. Practice questions, explanations, vote breakdowns, comments, and discussions are submitted by individual users and stored under their account. By submitting content to NerdExam, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, display, distribute, modify, format, and promote your contributions in connection with the NerdExam service.

You represent that you have the right to submit each contribution and that your contributions do not infringe any third party's copyright, trademark, privacy, or other rights. You retain ownership of your contributions, but grant the license described above for as long as NerdExam operates. You may participate in community discussions and voting; you agree to provide constructive, accurate contributions and to comply with our community guidelines (no spam, harassment, malware, or coordinated abuse).

5. Copyright Complaints, DMCA & Repeat-Infringer Policy

NerdExam respects the intellectual property rights of others and complies with the U.S. Digital Millennium Copyright Act (DMCA), the Hong Kong Copyright Ordinance (Cap. 528), and equivalent frameworks in other jurisdictions. If you believe content on NerdExam infringes your copyright, send a takedown notice with all required information (specific URL, identification of the original work, good-faith and accuracy statements, and your signature) to [email protected]. Counter-Notice. If your contribution was removed in response to a DMCA notice and you believe the removal was in error, you may submit a counter-notification to [email protected] following the procedure described on the DMCA Policy page. Reinstatement, where appropriate, occurs no fewer than 10 and no more than 14 business days after a valid counter-notice, unless the original complainant files a court action seeking to restrain the activity.

Repeat-Infringer Policy. NerdExam terminates the accounts of users who, in our reasonable determination, are repeat infringers. Three (3) or more valid DMCA notices issued against contributions submitted under a single account will result in suspension or termination of that account, forfeiture of any pending or future contributions, and (where applicable) a prohibition on creating replacement accounts.

Indemnification.To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless NerdExam, WADL Solutions Limited, and their officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) any content you submit or share through NerdExam; (b) your violation of these Terms; or (c) your violation of any third-party right, including copyright, trademark, privacy, or contractual rights.

No Guarantee of Accuracy or Currency. Practice questions, vote breakdowns, and explanations are user-submitted and may not reflect current or official certification exam content. NerdExam does not warrant the accuracy, completeness, or fitness for any particular purpose of any user contribution. Use this material as a study supplement, not as a substitute for official vendor preparation.

6. Guarantee & Refund Policy

NerdExam operates a two-tier refund system. Purchases that include the PDF Download add-on are covered under our Pass Guarantee: refunds are issued only upon verified failure of the corresponding official certification exam, subject to proof of score report submission within the required timeframe. Purchases without the PDF add-on are eligible for a 7-day refund subject to usage review. PDF downloads are non-refundable as immediately delivered digital goods. NerdExam monitors platform usage (sessions created, questions attempted, completion data) to evaluate refund eligibility. 7. Digital Downloads

PDF downloads are delivered as digital goods immediately upon purchase. By purchasing a PDF download, you acknowledge that: (a) the content is delivered instantly and cannot be returned or undelivered; (b) the download is for your personal study use only; (c) you may not redistribute, share, resell, or publish the content in any form; (d) the download is non-refundable once delivered; (e) your purchase of the PDF add-on subjects your entire order to the Pass Guarantee refund tier. Violation of these terms may result in account termination without refund.

8. Account Security & Sharing

Your NerdExam account is for your personal use only. You may not share, transfer, or sell your account credentials to any other person. NerdExam monitors for concurrent sessions and unusual access patterns. If we detect that an account is being shared or accessed by multiple individuals, we reserve the right to: (a) immediately suspend or terminate the account; (b) revoke all exam access without refund; (c) deny any pending or future refund requests. You are solely responsible for all activity that occurs under your account.

9. Content Protection

You may not capture, record, screenshot, download (except authorized PDF purchases), scrape, or otherwise reproduce NerdExam content by any means, including but not limited to: screen recording software, browser developer tools, automated scraping tools, browser extensions, or manual transcription. NerdExam reserves the right to implement technical measures to detect and prevent unauthorized content capture. Any attempt to circumvent these protections or extract content beyond your authorized access will result in immediate account termination without refund and may subject you to legal action under applicable copyright laws.

10. Chargeback & Dispute Policy

By purchasing from NerdExam, you agree to resolve any billing disputes directly with us at [email protected] before initiating a chargeback or dispute with your payment provider (Stripe, PayPal, or your bank/credit card issuer). If you initiate a chargeback or payment dispute without first contacting us, we reserve the right to: (a) permanently ban your account and all associated accounts; (b) pursue recovery of the disputed amount plus any chargeback fees incurred; (c) report the incident to fraud prevention databases; (d) deny all future access to NerdExam services. NerdExam maintains comprehensive delivery confirmation records and usage logs which will be submitted as evidence in any dispute.

11. Fraud Prevention & Account Integrity

NerdExam employs automated and manual fraud detection systems. The following activities are strictly prohibited and may result in permanent account termination without refund: (a) creating multiple accounts to circumvent refund policies or usage limits; (b) using different identities or payment methods to make repeated purchases and refund requests for the same exam; (c) submitting falsified, altered, or fraudulent score reports to claim refund eligibility; (d) purchasing products with the intent to dispute or reverse payment after accessing content. NerdExam reserves the right to verify score report authenticity through official vendor verification portals. We track payment methods, email addresses, and device information across accounts to detect and prevent abuse.

12. Limitation of Liability

NerdExam provides practice materials for study purposes. We do not guarantee exam pass rates. Our content is designed to supplement your study, not replace official study materials from certification vendors.

13. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time from your Settings page. Upon deletion, all personal data and practice history will be permanently removed.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email. Continued use of the service after changes constitutes acceptance of the updated Terms.

15. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. You agree that the courts of Hong Kong shall have non-exclusive jurisdiction to settle any dispute or claim arising out of these Terms. This clause does not affect any mandatory consumer protection rights you may have under the laws of your country of residence.
